AI Supplementary Terms

These AI Supplementary Terms (“AI Terms”) are part of the Terms of Use or Business Subscription Terms of Service (together, the “Agreement”) between you and The Brief. They govern your access to and use of any AI features made available by The Brief (“The Brief AI”). Capitalized terms not defined here have the meanings given in the Agreement.

SUMMARY:

  1. Access and Use. The Brief AI is part of the Services. You may submit content, data or materials to The Brief AI (“Input”), and The Brief AI will generate responses (“Output”) based on that Input. Both Input and Output are considered Customer Content and remain subject to these AI Terms, the Agreement and our Acceptable Use Policy.  
  2. Ownership and License Grant.
    1. As between you and The Brief: (i) you retain all right, title, and interest in your Input and Output; and (ii) The Brief retains all right, title, and interest in the Services and underlying technology.
    2. If you are using Free Subscription Plan (as described on our pricing page), you grant The Brief, its affiliates, successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, royalty-free license to reproduce, prepare derivative works of, display, perform, sublicense, and distribute the Output (for example, if you generate content using The Brief AI while on the Free Subscription Plan, The Brief may adapt portions of that Output into templates that can be made available within the Services for other customers to use). This license continues even after these AI Terms or your use of the Services ends. If you are using Pro, Teams, or Enterprise Subscription Plan (as described on our pricing page), no such license applies to your Output except as necessary for us to provide the Services to you.
  3. Customer Responsibilities. You are solely responsible for your Input and Output, including their development, content, and use. You must ensure that your use of The Brief AI does not: (i) violate any applicable law or regulation; (ii) violate the Agreement, these AI Terms, or the Acceptable Use Policy; (iii) infringe or misappropriate the rights of any third party; or (iv) include Personal Information (including biometric data) unless you comply with all applicable data protection and privacy laws, including providing required notices and obtaining consent. You are solely responsible for securing any rights or permissions needed to provide Input or to use Output.
  4. Disclaimer. You acknowledge that Output may: (i) contain errors, inaccuracies, or misleading information (“Hallucinations”); and (ii) not be unique, meaning other users may receive the same or similar Output. To the fullest extent permitted by law, The Brief disclaims all warranties, express or implied, regarding the Output, including accuracy, reliability, non-infringement, merchantability, and fitness for a particular purpose. You should independently verify any Output before relying on it.
  5. Training.
    1. Free Subscription Plan: The Brief may use Customer Content to maintain, improve, and enhance its Services for all users by training large machine learning models.
    2. Pro, Teams and Enterprise Subscription Plans: The Brief may use Customer Content from Pro and Team Subscription Plans to maintain, improve, and enhance its Services for all users by training large machine learning models, unless you opt-out through your account settings or otherwise agreed upon between the parties. By default, Customer Content from Enterprise Subscription Plans is not used for training large machine learning models, unless you expressly opt-in through your account settings or in a separate written agreement. Even if you opt-out or do not opt-in (in the case of Enterprise Subscription Plan), The Brief may still use Customer Content for the following purpose:
      1. Customer-Specific Fine-Tuning: The Brief may fine-tune models using Customer Content solely to improve model performance for the benefit of Customer, and not for the benefit of any other Customer or for any general-purpose use as part of some paid subscription plans; and
      2. Aggregate Structural Fine-Tuning: The Brief may fine-tune models in an aggregated and de-identified manner using layout, formatting, or structural patterns from multiple users, provided that the actual content is not used in a way that reflects or relies on its specific meaning or substance.
    3. New Features and Modifications. The Brief may introduce new features and functionalities from time to time that are considered part of The Brief AI offerings within the Services. The Brief may modify these AI Terms from time to time by updating this web-page. Continued use of the Services after changes take effect constitutes acceptance of the updated AI Terms.
